These Terms of Service (“Terms”) govern your access to and use of the Ghydion website, The Ghydion Gallon™ smart bottle, any related mobile applications, and all associated services, content, and intellectual property (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 13 years of age to access or use the Services. By using the Services, you represent and warrant that you meet this requirement.
At this time, the Ghydion website does not require users to create an account. However, we reserve the right to introduce account-based features in the future.
If user accounts are implemented, you agree to:
Provide accurate and complete information
Maintain the security of your login credentials
Accept responsibility for all activity conducted under your account
You will be notified of any material changes related to account functionality.
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You agree not to:
Misuse, disrupt, or interfere with the Services
Attempt unauthorized access to systems or data
Manipulate hydration data, streaks, challenges, or leaderboard features
Reverse engineer, copy, or exploit any portion of the Services
Use the Services in a way that violates applicable laws or regulations
The Ghydion Gallon™ and its companion application are currently in development. Any features, timelines, or descriptions provided are subject to refinement as development progresses.
If you place a preorder or otherwise support the product:
You acknowledge that development timelines are estimates
You understand that funds may be used to advance development, testing, tooling, manufacturing, and fulfillment
You agree that progress updates will be provided as milestones are reached
The Services are provided for informational and motivational purposes only.
The Ghydion Gallon™:
Is not a medical device
Does not provide medical advice
Is not intended to diagnose, treat, cure, or prevent any medical condition
Always consult a qualified healthcare professional regarding hydration, fitness, or health-related decisions.
If social or community features are enabled:
You are solely responsible for content you choose to share
You agree not to post content that is unlawful, abusive, misleading, or infringing
Ghydion reserves the right (but not the obligation) to moderate, restrict, or remove content that violates these Terms or community standards.
All content, software, designs, trademarks, logos, text, graphics, and other intellectual property associated with the Services are owned by Ghydion Co. or its licensors.
No rights or licenses are granted to you except as expressly stated in these Terms. Unauthorized use is strictly prohibited.
We reserve the right to suspend or terminate access to the Services at any time if:
These Terms are violated
The Services are misused
Required by law or regulatory obligation
Termination may occur without prior notice where appropriate.
To the fullest extent permitted by law:
The Services are provided “as is” and “as available”
Ghydion shall not be liable for indirect, incidental, consequential, or special damages
Use of the Services is at your own risk
Some jurisdictions do not allow certain limitations, so these provisions may not apply to you in full.
You agree to indemnify and hold harmless Ghydion Co., its officers, directors, employees, and partners from any claims, damages, or expenses arising out of:
Your use of the Services
Your violation of these Terms
Your infringement of any third-party rights
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law principles.
We may update these Terms from time to time. Any material changes will be posted on the website or communicated through the Services. Continued use after changes constitutes acceptance.
